1. General
These warranty conditions apply to used and refurbished bicycles and e-bikes purchased via Yeply Recycled.
Yeply Recycled bicycles are used products and not new bicycles. As a result, they may show cosmetic and functional signs of wear consistent with age and use.
This warranty is a voluntary commercial warranty offered additionally by Yeply. This warranty does not prejudice the consumer's statutory rights under Dutch law, including the right to a sound product (conformity, Article 7:17 of the Dutch Civil Code).
2. Warranty period
Yeply offers a commercial warranty of 12 months from the date of purchase, unless otherwise stated for a specific product.
This warranty also applies to:
- the motor of the e-bike
- the e-bike battery
This commercial guarantee is separate from and does not affect the statutory rights of the consumer, which may continue to apply even after the expiry of this period.
3. Scope of the warranty
The warranty covers exclusively defects resulting from material or manufacturing faults that occur within the warranty period under normal use.
A defect is covered by the warranty if:
- it was already present upon delivery, or
- it is the result of an underlying defect that was present at the time of delivery
Yeply assesses on a case-by-case basis whether a defect is covered under warranty.
If a defect is covered by the warranty, Yeply may, at its own discretion:
- repair the defect
- replace the defective part
- offer a (partial) reimbursement for the part or the product
Yeply reserves the right to determine the appropriate solution.
4. Exclusions from the warranty
4.1 Normal wear and tear
Normal wear and tear consistent with the age, use, and condition of a used bicycle is not covered by the warranty.
This includes, among other things, wear that develops gradually or manifests as sudden functional deterioration, provided that this is in line with what may reasonably be expected of a used product.
If there is wear and tear that is disproportionate to the age or use of the bicycle, this may still be considered a defect.
4.2 Parts and components
The warranty does not cover normal wear and tear of parts, including but not limited to:
- chains, sprockets, cables and cable sleeves
- brake pads and brake discs
- tires and inner tubes
- suspension bearings, seals and maintenance parts
- natural capacity reduction of the e-bike battery due to use and aging
4.3 Use, maintenance and external causes
The warranty does not cover defects resulting from:
- incorrect use or use contrary to instructions from Yeply or the manufacturer
- negligence or injudicious use
- insufficient or unperformed maintenance, insofar as the defect was caused thereby
- accidents, falls, collisions or other external damage
- intensive or professional use (such as rental or courier services), unless otherwise agreed in writing
4.4 Other exclusions
The warranty does not cover:
- changes, adjustments, or modifications to the bicycle
- defects caused by non-original or incompatible parts
- repairs carried out by third parties without prior approval from Yeply
- accessories (such as locks, lights, carriers or mudguards), unless otherwise indicated
5. Maintenance and burden of proof
To claim under this warranty, the bicycle must have been reasonably maintained.
The following applies as a guideline:
- maintenance at least every 12 months or every 1,000 kilometers, whichever comes first
Yeply may request the customer to demonstrate that maintenance has been performed, for example by means of:
- a maintenance invoice
- a maintenance booklet
- other relevant documentation
Lack of maintenance can only lead to refusal of warranty if the defect was caused by it.
The statutory rules regarding the burden of proof remain fully applicable.
6. Warranty procedure
In the event of a possible defect, the customer must contact Yeply before repairs are carried out.
Yeply is not obliged to reimburse costs arising from:
- repairs carried out without prior permission from Yeply
- transport, storage or downtime of the bicycle, unless otherwise agreed in writing
7. Liability
This warranty applies exclusively to the bicycle and the associated parts.
To the extent permitted by law, Yeply is not liable for indirect damages, including but not limited to:
- consequential damage
- loss of use
- loss of income
This limitation does not apply in cases of intent, gross negligence, or if liability cannot be excluded pursuant to mandatory law.
8. Transferability
This commercial warranty applies exclusively to the original purchaser and is not transferable.
This does not affect any legal rights of a subsequent owner.
9. Applicable law
These warranty conditions are governed by Dutch law.
